EPC mandatory in Flanders for large surfaces from 2025

The Energy Performance Certificate for Non-Residential Building Units (EPC NR) serves as a tool to guide owners towards the long-term objective of carbon neutrality. It informs potential buyers or tenants about the energy performance of the unit they want to purchase or rent. Within five years of the sale (or other transfers), owners must comply with the renovation obligation, with a minimum energy label that must be demonstrated via an EPC NR (or 'kNR').

Timeline The EPC NR has been mandatory since 1 January 2023 for the sale (including building rights and leasehold) and rental (when entering into new leases) of non-residential units.

The obligation to have an EPC NR will be gradually tightened in Flanders, so that every large non-residential building unit will have an EPC by 2026, regardless of whether it is transferred or rented.

  • 2025: From 1 January 2025, every large non-residential building unit with a usable floor area of 1000 m² or more must have an EPC NR, regardless of sale or rental.

  • 2026: From 1 January 2026, this is required for large non-residential building units with a floor area of less than 1000 m².

  • 2028: From 1 January 2028, all large public and government buildings (with the exception of community education and subsidised education) must have a valid EPC NR, with at least label E. Since 1 January 2024, all large building units of public buildings and government buildings must already have an EPC for non-residential buildings. The old EPC Public can no longer be used to meet the obligations for public buildings.

  • 2030: From 1 January 2030, every large non-residential unit must have a valid EPC NR, with at least label E.
