AGREEMENT TO OUR LEGAL TERMS

We are CBRE SA, a Belgian public limited company registered under enterprise number BE 0412.578.810, operating under the name CBRE (hereinafter "Company", "we", "us", or "our").

We operate the website https://propertyweb.be (the "Site") as well as all associated services (collectively, the "Services").

PropertyWeb allows you to:

Search for real estate properties in Belgium (offices, retail, logistics, residential)
Save your personalized search strategies
Receive email notifications about new properties matching your searches

By creating an account, you accept these terms in their entirety. IF YOU DO NOT AGREE WITH THESE TERMS, YOU MAY NOT USE THE SERVICES.

We reserve the right to modify these Terms at any time. Any modification will be communicated by updating the "Last updated" date. Your continued use of the Services after modification constitutes acceptance.

Minors must obtain permission from a parent or guardian before using the Services.

1. OUR SERVICES

PropertyWeb is a real estate search platform. The information provided is not intended for use in jurisdictions where distribution would be contrary to law.

By accessing the Services from abroad, you do so at your own initiative and are responsible for compliance with local laws.

Important: CBRE is a connecting platform. We do not directly market real estate properties and are not party to transactions between users and owners/agents.

2. INTELLECTUAL PROPERTY

Our intellectual property

We own or hold licenses to all intellectual property rights in the Services, including content, databases, functionalities, design, texts, photos, graphics (the "Content"), as well as trademarks and logos (the "Marks").

Content and Marks are protected by Belgian, European, and international copyright and trademark laws.

Your use of our Services

Subject to compliance with these Terms, we grant you a non-exclusive, non-transferable, and revocable license to:

Access the Services
Download or print a copy of Content to which you have lawfully gained access

For your personal and non-commercial use only.

Except as expressly authorized, you may not copy, reproduce, redistribute, sell, or exploit Content or Marks for commercial purposes.

Your submissions

By sending us suggestions, ideas, comments, or feedback ("Submissions"), you assign to us all intellectual property rights in such Submissions. We may use them freely without compensation obligation.

You are responsible for your submissions. You warrant that they:

Comply with our Terms and applicable laws
Do not violate any third-party intellectual property rights
Do not contain illegal, defamatory, obscene, discriminatory, or misleading content

3. USER REPRESENTATIONS

By using the Services, you represent and warrant that:

All registration information you provide is truthful, accurate, and complete
You will maintain the accuracy of such information
You have legal capacity to accept these Terms
You are not a minor, or if you are, you have obtained parental authorization
You will not access the Services through automated means (bots, scripts)
You will not use the Services for illegal or unauthorized purposes
Your use will not violate any applicable law

If you provide false or incomplete information, we reserve the right to suspend or delete your account.

4. REGISTRATION

Account creation

You can create an account in two ways:

A. By email and password

Provide a valid email address
Set a secure password (minimum 8 characters)

B. Via Google

Sign in with your Google account
We will receive: email, name, first name, profile photo
We NEVER receive your Google password

Your obligations

You agree to:

Keep your credentials confidential
Be responsible for all activity on your account
Immediately inform us of any unauthorized use

We reserve the right to remove any username deemed inappropriate, obscene, or otherwise objectionable.

5. PROHIBITED ACTIVITIES

You may not use the Services for any purpose other than that intended. As a user, you agree NOT to:

Systematically collect data from the Services
Deceive or mislead other users
Circumvent security measures of the Services
Disparage, harm the reputation of CBRE or the Services
Use information obtained to harass or harm others
Use the Services contrary to applicable laws
Create unauthorized links to the Services
Upload viruses, malware, or malicious code
Use automated systems (scraping, bots, robots)
Attempt to impersonate another user
Use the Services for competing commercial activities
Sell, copy, or exploit the Services for commercial purposes without authorization
Interfere with the operation of the Services
Harass our employees or agents
Attempt to circumvent access restrictions
Copy or adapt the Services software
Decompile, disassemble, or reverse engineer the software
Use the Services to send spam or unsolicited content

Any violation may result in suspension or termination of your account.

6. GOOGLE AUTHENTICATION

Google authentication

PropertyWeb allows you to sign in via Google ("Third-Party Account").

By using this option, you:

Authorize CBRE to receive certain information from Google (email, name, first name, photo)
Accept that this use is governed by Google's terms
Understand that CBRE is not responsible for Google's practices

Your rights

You can:

Revoke access at any time from your Google account settings
Disconnect your PropertyWeb account from Google via the /profile page

Important: Deleting your PropertyWeb account is independent of your Google account. To completely remove access, also revoke permissions in Google.

7. THIRD-PARTY WEBSITES

The Services may contain links to third-party websites or third-party content.

CBRE is not responsible for:

The accuracy, content, or practices of third-party sites
Purchases made through third-party sites
Any damage resulting from the use of third-party sites or content

If you leave PropertyWeb to access a third-party site, you do so at your own risk.

8. SERVICES MANAGEMENT

We reserve the right to:

Monitor the Services for violations
Take legal action against violators
Refuse, restrict access to, or remove content
Remove excessively large files
Manage the Services to protect our rights and ensure proper operation

9. PRIVACY POLICY

We place great importance on protecting your personal data.

By using the Services, you accept our Privacy Policy accessible on the Site.

Hosting: The Services are hosted on servers located in Amsterdam (Netherlands) and London (United Kingdom), as well as on Firebase (Europe and United States). If you access the Services from another region, you consent to the transfer of your data to these locations.

10. TERM AND TERMINATION

Term

These Terms remain in effect as long as you use the Services.

Termination by CBRE

We reserve the right to suspend or delete your account at any time, without notice, particularly in case of:

Violation of these Terms
Violation of applicable laws
Behavior harmful to the Services or other users

Termination by you

You can delete your account at any time from the "My Account" page (/profile).

Consequences of termination

Upon deletion of your account:

Your personal data will be retained for 1 month then permanently deleted
You will no longer have access to saved searches
You may not create a new account with the same information if we terminated your account for violation

11. MODIFICATIONS AND INTERRUPTIONS

Modifications

We reserve the right to modify or interrupt all or part of the Services at any time, without notice or liability.

Interruptions

We do not guarantee that the Services will be available continuously. Interruptions may occur for:

Technical maintenance
Updates
Technical problems
Force majeure

You accept that we are not liable for losses, damages, or inconveniences caused by unavailability of the Services.

12. GOVERNING LAW

These Terms are governed by Belgian law.

If you are a consumer residing in the European Union, you also benefit from the protection of mandatory provisions of the law of your country of residence.

CBRE and you accept the non-exclusive jurisdiction of the courts of Brussels, Belgium. As a consumer, you may also bring proceedings in the courts of your country of residence.

13. DISPUTE RESOLUTION

For European consumers

In case of dispute, we encourage you to contact us first to attempt to find an amicable solution.

If no solution is found, you can:

Bring proceedings in competent courts
Use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr

Complaint

You may also lodge a complaint with the data protection authority of your country.

14. CORRECTIONS

The Services may contain typographical errors, inaccuracies, or omissions regarding descriptions, prices, availability, and other information.

We reserve the right to correct any error, inaccuracy, or omission, and to modify or update information at any time, without notice.

15. DISCLAIMER

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE".

To the fullest extent permitted by law, CBRE disclaims all warranties, express or implied, regarding the Services, including:

Warranties of merchantability
Fitness for a particular purpose
Absence of errors or interruptions

We do not guarantee:

Accuracy or completeness of content
Continuous availability of Services
Absence of viruses or other malicious code
Availability of advertised properties

We are not responsible for:

Content of listings published by third parties
Transactions between users and advertisers
Indirect damages (loss of profit, clientele, opportunity)

You use the Services at your own risk.

16. LIMITATION OF LIABILITY

To the fullest extent permitted by law, CBRE, its directors, employees, and agents shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages, including:

Loss of profits
Loss of revenue
Loss of data
Loss of business opportunities

This limitation applies even if we have been informed of the possibility of such damages.

Exceptions

This limitation does not apply:

In case of gross or intentional fault by CBRE
To bodily injury
To GDPR violations
To any other liability that cannot be legally excluded

For business users (B2B)

In case of direct damage resulting from simple negligence by CBRE, our liability is limited to EUR 1,000 per incident, except in case of gross or intentional fault.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless CBRE, its subsidiaries, affiliates, directors, agents, partners, and employees against any claim, loss, liability, damage, or expense (including attorney fees) arising from:

Your use of the Services
Your violation of these Terms
Your violation of third-party rights
Any action harmful to another user

We reserve the right to assume exclusive defense of any matter requiring your indemnification, at your expense.

18. USER DATA

We retain certain data you transmit to the Services to manage their performance and your use.

Your responsibilities:

You are solely responsible for the data you transmit
We perform regular backups but do not guarantee against data loss or corruption

You waive any right of action against us in case of data loss or corruption.

19. ELECTRONIC COMMUNICATIONS

By using the Services, you consent to receive electronic communications from us.

You accept that all agreements, notices, disclosures, and other communications we provide electronically (email, Services) satisfy any legal requirement for written communication.

YOU ACCEPT THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, AND TRANSACTIONS.

20. MISCELLANEOUS

Entire agreement

These Terms constitute the entire agreement between you and CBRE regarding use of the Services.

Severability

If any provision is deemed invalid or unenforceable, other provisions remain fully in effect.

Waiver

Our failure to exercise a right does not constitute a waiver of that right.

Assignment

We may assign our rights and obligations at any time. You may not assign these Terms without our written consent.

No relationship

No employment, partnership, agency, or joint venture relationship is created between you and CBRE as a result of these Terms.

Language

In case of conflict between different language versions, the French version prevails.
